Terms of Service
Last updated: 29 October 2026. Version: 2026-10-29.
1. Who we are
AI Marketing Master ("the Service") is run by Shivah Web Tech Private Limited ("Shivah Web Tech", "we", "us", "our").
- Offices: Mohali, Punjab, India, and Troy, Michigan, USA.
- Registered office: Mohali, Punjab, India. Ask us by email for the full address.
- Email: dev@shivahwebtech.com
- Phone: +91 85808 92163
These terms are a contract between us and the business or person that signs up ("you", "the customer"). If you sign up for a company, you confirm that you may bind that company to these terms.
These terms work together with:
- our Privacy Policy,
- our Refund and Cancellation Policy,
- our Cookie Policy, and
- our Acceptable Use Policy.
If you need a data processing agreement for the personal data of your own customers, email us.
2. Words we use
- Workspace: your account space. It holds your business details, content, team and billing.
- Agency: a workspace that manages marketing for other businesses.
- Client: a business that a workspace does marketing for. An agency can have many clients.
- User: a person who signs in to a workspace, such as an owner, admin, team member, reviewer or client user.
- Your Content: everything you or your users put into the Service, and everything the Service makes for you. This includes business facts, files, drafts, posts, pages, reports and lead records.
- Connected Account: an outside account you link to the Service, such as a Facebook Page, Google account or WordPress site.
- Credits: units in your workspace wallet that pay for some costly work, such as AI images, video and voice.
3. Who can use the Service
- The Service is for businesses and people acting for a business. It is not for personal, family or household use.
- You must be at least 18 years old and able to make a binding contract.
- The Service is not directed at children. Do not create accounts for children.
- You must give true and complete sign-up details and keep them up to date.
4. Your account and security
- Keep your password safe. Do not share sign-in details.
- You can turn on two-factor sign-in and passkeys in Settings. We strongly recommend it. Our own staff must use two-factor sign-in to reach our admin area.
- You are responsible for what happens in your workspace, including actions by users you invite.
- Tell us at once if you think someone has used your account without permission.
5. Roles, agencies and clients
- Each user has a role (for example owner, admin, manager, content writer, reviewer, finance or client). Roles decide what a user can see and do. We check these permissions on our servers, not only on screen.
- Each workspace's data is kept separate from other workspaces.
- If you are an agency: you are responsible to your own clients. You must have their permission to connect their accounts, use their business details, publish for them and handle their leads. You decide which clients and client users can see what. You must give your clients any notices the law requires.
- If you use white-label features (your own name, logo or custom domain), you are still bound by these terms. Your clients' use of the Service through you is your responsibility.
6. What the Service does
The Service helps you plan, create, check, approve and publish marketing work. Depending on your plan and the connections you set up, it can:
- write drafts such as blog posts, pages, social posts and ads using business facts you approve,
- make AI images and short AI videos,
- check content against rules (names, phone numbers, prices, banned claims, duplicates, required fields and high-risk wording),
- audit websites and show what it found, with evidence,
- publish to accounts you connect, then check that the work really appeared,
- collect leads from your forms, landing pages and ad platforms,
- make reports and invoices, and
- answer questions through our assistant (Milo), by text or, if switched on, by voice.
Some features need outside providers or approvals that may not be ready yet. The Service shows the real status of each feature (for example "Not configured" or "Sandbox"). We do not claim a feature works when it does not.
7. AI-generated content and its limits
- The Service uses outside AI providers to write, check, make images, make video and handle voice. Our Privacy Policy explains which kinds of providers we use.
- AI can be wrong. It can produce text that is out of date, incomplete, unsuitable or similar to other material. You must review AI output before you use it.
- The Service is built not to invent prices, offers, guarantees, reviews, statistics or results. If a fact is missing, it asks you. But it cannot prove that a fact you gave us is true. You are responsible for the facts you approve and the claims you publish.
- Our checks reduce risk. They do not guarantee that content is lawful, accurate or acceptable to a platform.
- AI images are made as illustrations. They must not be used to show a real person, a real product or a real event as if they were a photo of it.
- Some websites block automated checks. When we cannot check something, we say "unable to check". We do not call it a pass.
8. Approvals and automation
- By default, nothing is published and no ad money is spent without approval by the right person in your workspace.
- Approval is for an exact version. If the content changes after approval, it needs a new approval.
- Content that fails a mandatory check cannot be published, even if someone approved it.
- Approval links sent by email or WhatsApp are single-use and expire (48 hours by default). They never sign anyone in.
You can choose to switch on automatic options. Each one is off until a person with the right permission turns it on:
- Autopilot for a client, content type and destination. Mandatory checks still apply. Sensitive or high-risk content still goes to a person.
- A "no reply" rule: low-risk content that has waited the number of days you chose may be approved automatically.
- Automatic replies to social media comments: only praise and simple questions. Complaints and sensitive comments go to a person. Spam is never answered.
- Ads Autopilot: launches checked ad drafts inside a monthly spending cap you set and agree to. It never raises a budget and never changes ads that people launched themselves.
When you switch on an automatic option, you authorise the actions it takes within its limits. You can switch it off at any time.
These actions always need a person's clear permission: launching ads, changing ad budgets, and deleting data. The Service never changes your website hosting or DNS.
9. Connected accounts and outside platforms
- You may connect accounts such as Facebook Pages, Instagram, LinkedIn, YouTube, X, Google (Search Console, Analytics, Business Profile, Ads), Meta ad accounts, WordPress, Shopify, GitHub and HubSpot.
- You confirm that you own these accounts or have permission to connect them.
- Each platform has its own terms and policies, such as Meta's and Google's advertising and platform policies. You must follow them. Your use of those platforms is between you and them.
- Platforms can change their rules, limit access, reject content or suspend accounts. We are not responsible for their decisions. We cannot promise that any platform will accept, show or keep your content or ads.
- We store sign-in tokens and passwords for connected accounts in encrypted form. We use them only to do the work you ask for. You can disconnect an account at any time. You may also need to remove our access inside the platform itself.
- Ad spend is charged by the ad platform to your own ad account. It is not part of our fees. We never collect or hold your ad spend.
- If a connection expires or a platform is down, we pause the affected work, keep your content safe, tell you, and show how to reconnect.
10. Your marketing must follow the law
You are responsible for your own marketing. This includes:
- the truth of your ads, posts, pages, offers and claims,
- getting any consent the law needs before you contact people, track them or share their data (for example with Meta through the Conversions API),
- following advertising, consumer protection, data protection, spam and telemarketing rules in every country where you market, and
- following sector rules (for example health, finance, legal services, real estate and education).
The Service does not send marketing messages to your leads. If you contact leads yourself, you must have the right to do so.
11. Leads and personal data you give us
- When you collect leads or put other people's personal data into the Service, you decide why and how that data is used. We handle it on your behalf and on your instructions, to provide the Service.
- You must have a lawful basis and give any notice the law requires to those people.
- You must not upload sensitive personal data (such as health, financial account, biometric or children's data) unless we have agreed in writing.
- For leads and other personal data of your own customers that you put into the Service, you decide why and how it is used and we process it for you. For your own account data, we decide, as our Privacy Policy explains.
12. Plans, trials and payment
- Plans, prices, limits and taxes are shown before you pay. Current plan prices may be marked "demo" until final prices are set.
- Trial. New workspaces start with a free trial (currently 3 days). The trial may be extended once if you complete your business profile. A trial does not charge you automatically. When the trial ends, you need to choose and pay for a plan to keep using paid features.
- Prepaid months. Paid plans are paid one month in advance. A paid month keeps the plan you paid for.
- Autopay. You can choose to pay each month automatically. You can turn autopay off at any time. The paid month keeps running.
- Payment providers. Payments in Indian rupees go through Razorpay or Cashfree. Payments in other currencies (USD, GBP, CAD, AED, AUD) go through Stripe. Card details are entered on the provider's own page. We never see or store your full card number.
- Taxes. Indian customers receive a GST invoice where GST applies. For customers outside India we issue an invoice without Indian GST where the law allows it. You are responsible for any tax due in your own country.
- Late or failed payment. If a renewal is not paid, you have 7 days to pay. After that, the workspace becomes read-only. You can still look and export your data.
- Price changes. We give you at least 30 days' notice by email before a price change. It applies from your next renewal after the notice.
13. Credits and usage limits
- Plans include monthly limits (for example posts, AI generations, images, video and voice minutes). The Service warns you at 80% and stops at 100% of a limit.
- Some work is paid with credits. Plan credits end with the paid month and do not roll over. Trial credits end when the trial ends. Bought credit packs do not expire. Bonus credits (for example referral rewards) end after the period shown.
- Before costly work starts, the credits it needs are held. If the job fails before the provider charges for it, the held credits are returned. If the result is not delivered, staff may give the credits back.
- Credits have no cash value. They cannot be sold, transferred or exchanged for money, except as our Refund and Cancellation Policy says.
- We may pause AI work for everyone for a time if our own monthly AI budget is reached. Credits are not taken for work that did not run.
14. Cancellation, pause and refunds
- You can cancel at any time in Billing. A paid plan stays active until the end of the paid month. A cancelled trial ends at once.
- After cancellation, the workspace is read-only for 30 days so you can export your data.
- You can pause a paid plan for 1 to 3 months. The pause starts when the paid month ends. While paused, nothing is published or generated, and your data is kept.
- Refunds follow our Refund and Cancellation Policy.
15. Your content and our rights
- You own Your Content. We do not claim ownership of it.
- You give us a limited licence to host, copy, process, change format, send and show Your Content only to run the Service for you, keep it secure, and meet the law. This licence ends when your content is deleted, except for copies in backups until they roll off, and records we must keep by law.
- You confirm you have the rights to everything you upload, including images, music, logos and text.
- AI output. As between you and us, you may use the output the Service makes for you. We cannot promise that AI output is unique or that it can be protected by copyright.
- Our rights. The Service, its software, design, templates, and our brand belong to us or our licensors. You may not copy, resell or reverse engineer the Service.
- Feedback. If you send ideas or suggestions, we may use them without paying you.
16. Landing pages and public content
- Landing pages you publish through the Service are public. Every published landing page has a "Report this page" link.
- Our staff review reports. We may take a page down if it breaks these terms or our Acceptable Use Policy, or if the law requires it.
- We act on valid court orders and government notices to remove content within the time the law sets.
17. Your data: export and deletion
- Owners can export workspace data as a ZIP file. The download link lasts 7 days. Passwords, tokens and keys are never included.
- Owners can ask us to delete a workspace. Deletion happens after a 30-day grace period. During that time the workspace is read-only and the request can be cancelled.
- After deletion, copies may stay in our backups until those backups roll off on their own schedule. GST invoices are kept for the period the law requires (currently 8 years after the end of the financial year).
- Our Privacy Policy explains this in more detail.
18. Service changes and availability
- We work to keep the Service available, but we do not promise it will always be available or free of errors. We do not promise a fixed uptime. For support, email dev@shivahwebtech.com or message +91 85808 92163 on WhatsApp.
- Some features are marked early access, sandbox or not configured. They may change or stop.
- We may change or remove features. If a change takes away a major paid feature, we will tell you at least 30 days in advance by email where we reasonably can.
19. No guaranteed results
We do not promise any result, including search rankings, traffic, AI answer visibility, leads, sales, ad performance, reach or followers. Search engines, AI tools and social platforms decide what they show. A page may not be shown or ranked even after it is published.
20. Disclaimers
To the extent the law allows, the Service is provided "as is" and "as available". We do not give any promise or warranty that is not written in these terms. Nothing in these terms limits any right you have by law that cannot be excluded.
21. Limits on our liability
- We are not liable for indirect or consequential loss, such as lost profit, lost revenue, lost data you could have backed up, or loss of goodwill.
- We are not liable for the acts or decisions of outside platforms and providers, or for content you approved or published.
- Our total liability for all claims in any 12 months is limited to the fees you paid us for the Service in the 12 months before the claim.
- Nothing in these terms limits liability that the law does not allow us to limit, such as liability for fraud.
22. Your responsibility to us
You agree to cover our reasonable losses and costs from claims by others that arise because:
- Your Content breaks the law or someone's rights,
- you break these terms or our Acceptable Use Policy, or
- you use a connected platform against its rules.
23. Suspension and ending the contract
- We may limit or suspend a workspace, or put paid actions on hold, if we reasonably believe there is fraud, a chargeback, a security risk, a serious breach of these terms, or a legal requirement. Where we can, we will tell you why and how to fix it.
- We may end the contract for a serious breach that is not fixed after notice. We will give you 14 days' written notice to fix it first, unless the breach cannot be fixed or the law requires us to act at once.
- When the contract ends, you can export your data during the read-only period. Then deletion follows the rules above.
24. Changes to these terms
When these terms change in an important way, we will tell you and ask you to accept the new version. We record which version you accepted and when.
25. Governing law and disputes
- These terms are governed by the laws of India. The courts at Mohali, Punjab, India have jurisdiction. This does not take away any consumer right you have in your own country.
- Please contact us first. Most problems can be solved quickly.
